Nuclara Terms of Service
These terms are an agreement between you and DigiCreations LLC ("we"), the developer and operator of the Nuclara application and related services (the "Service"). By creating an account or using the Service you agree to them, to the Privacy Policy, and to the SMS Terms.
1. What Nuclara is — and is not
Nuclara helps you record and organise health information — medications, vitals, appointments, diagnoses, and related notes — for yourself or people you care for. Nuclara does not provide medical advice, diagnosis, or treatment and is not a substitute for a qualified healthcare professional. In an emergency, contact local emergency services.
2. Eligibility and accounts
You must be 18 or older to create an account. You are responsible for keeping your sign‑in methods (email, phone, passkeys) secure and for all activity under your account. Tell us promptly at hello@digicreations.net if you believe your account has been compromised.
3. Text messages
If you enter a mobile number, we will text you a one‑time verification code. If you enable SMS notifications, we may also text service notices. Message and data rates may apply. Reply STOP to opt out or HELP for help. We do not send marketing texts. See the SMS Terms.
4. Your content
You own the information you enter. You grant us a limited licence to store, process, and transmit it solely to operate the Service for you. You are responsible for having the right to enter information about other people, and for its accuracy.
5. Acceptable use
Do not use the Service unlawfully, attempt to access other users' data, interfere with the Service, or reverse‑engineer it except where the law permits.
6. Availability and changes
We aim for the Service to be available but do not guarantee uninterrupted access. We may change or discontinue features with reasonable notice, and will give you the opportunity to export your data before discontinuing the Service.
7. Termination
You may delete your account at any time. We may suspend or close accounts that violate these terms. Data is deleted as described in the Privacy Policy.
8. Disclaimers and limitation of liability
The Service is provided "as is". To the fullest extent permitted by law, we disclaim implied warranties and are not liable for indirect, incidental, or consequential damages, or for decisions made on the basis of information stored in the Service. Our total liability to you is limited to the greater of USD 100 or the amount you paid us in the preceding twelve months.
9. Governing law
These terms are governed by the laws of the State of Colorado, USA, without regard to conflict‑of‑law rules. Nothing here limits mandatory consumer‑protection rights in your place of residence.
10. Changes to these terms
We will post updates here with a new effective date and, for material changes, ask you to accept them inside the app before continuing.
